Terms & Conditions for accessing the restricted section

Based on User information provided and your acceptance of the following User Agreement, you will be authorized to access the password-protected content on the following Web site(s):

For purposes of the User Agreement, Web site(s) refer to this site listed above. Upon successful completion of the User Agreement, the Web site User will be able to access the Web site(s) with the user name and password pair that have been provided (in Step 2). The term Web site User (or, User) refers to the authorized individual (it should be you) who is requesting and receiving an account.

After carefully reviewing this agreement, press the “I Agree” button at the bottom of the page if you accept its terms and would like to obtain Web site access. Press the "I Do Not Agree” button if you cannot accept or do not wish to comply with the terms of the User Agreement. In this case, the User will not be permitted in the restricted section.

Citizenship and Country of Residence

The issues related to verifying citizenship and country of residence to allow access to Web site content are complex. As such, if either your citizenship or country of residence are not the USA, please review the appropriate citizenship and country of residence requirements for obtaining an account before proceeding to the next section of this User agreement to determine if you qualify for an account.

Citizenship and Country of Residence Requirements

The citizenship and country of residence of a person requesting Web site access must be considered for determining eligibility for the account because of export control requirements. An export will occur to a person's country of citizenship and country of residence when the Web site is accessed. In addition, there are other export control requirements (i.e., agreeing to comply with applicable export control laws and limitations on re-exporting technical data) that must be satisfied.

Questions or comments regarding these requirements may be directed to the webmaster. Specifics related to the citizenship and country of residence requirements are listed below:

United States Citizen or Equivalent Status:
If a person requesting a Web site account is a U.S. Citizen, is a permanent resident of the U.S., has been granted refugee status in the U.S. or has been granted political asylum in the U.S., that person may be treated as a United States citizen for export control purposes.

  • In this case, a person is eligible to receive a Web site account if they agree to comply with all terms and conditions of the Web Site User Agreement, and their country of residence is not one of the listed export controlled or embargoed countries (D or E Group countries, see list ).
  • If the person is resident in any of these export controlled or embargoed countries, that person is not eligible to receive Web site access. In this case, the country of residence presents an export control problem. Should that person no longer reside in any of the listed export controlled or embargoed countries, that person can revisit the Web site to determine if a Web site account may then be provided.

Other Citizenship Status:
If a person requesting a Web site account is not a U.S. Citizen, is not a permanent resident of the U.S., has not been granted refugee status in the U.S., or has not been granted political asylum in the U.S., the export control status of the person and Web site account eligibility depend on other factors:

  • If a person is not a citizen of any listed export controlled or embargoed country (D or E Group countries, see list ) and is not a resident of any listed export controlled or embargoed country (D or E Group countries, see list), then the person is eligible to receive a Web site account if they agree to comply with all terms and conditions of the Web site User Agreement. In this case, the country of citizenship and the country of residence do not present an export control problem.
  • If a person is not a citizen of any listed export controlled or embargoed country (D or E Group countries, see list ) and is a resident of any listed export controlled or embargoed country (D or E Group countries, see list), then the person is not eligible to receive a Web site account. In this case, the country of residence presents an export control problem given the country of citizenship. Should that person later reside in a country other than any listed export controlled or embargoed countries, that person can revisit the Web site to determine if a Web site account may then be provided.
  • If a person is a citizen of any listed export controlled or embargoed country (D or E Group countries, see list ) and is a resident of the United States, then the person may be eligible to receive a Web site account. In this case a person is eligible to receive a Web site account if they agree to comply with all terms and conditions of the Web Site User Agreement and written assurance of export compliance is received from someone in a position of authority within the organization the person represents (i.e., a member company or a sponsored university) as listed in the User's personal description. The written assurance should state that the person is employed by the listed organization in full compliance with applicable export control laws and regulations, that providing Web site access is authorized given that person's role in their organization, and that the person agrees to comply with applicable export control laws and regulations associated with Web site access. In this case, the country of citizenship presents an export control problem that may be overcome with the above measures.   • If a person is a citizen of any listed export controlled or embargoed country (D or E Group countries, see list) and is not a resident of the United States, then the person is not eligible to receive a Web site account. In this case, the country of residence presents an export control problem given the country of citizenship. Should that person later reside in the United States, that person can revisit the Web site to determine if a Web site account may then be provided.

Export Control Requirements for Obtaining an Account

Access to, receipt of, transmission of, and the disposition of information, technology, data or software from the Web site(s) must be in accordance with all applicable U.S. export control laws and federal agency regulations. The information, technology, data, and software accessed from the Web site(s) are typically the results of sponsored fundamental research programs conducted at universities in the United States and Canada. The User agrees to comply with all citizenship, country of residence, and export control based limitations on Web site access relating to listed export controlled and embargoed countries. Further, the User agrees not to export or re-export Web site contents in any form, except in full compliance with all applicable U.S. export control laws and related federal agency regulations.

In addition, the Web site User certifies and agrees that any information, data, software or technology obtained from or through the Web site(s):

  • will not be accessed from or used in any form within any of the listed export controlled or embargoed Countries (D or E Group countries, see list), and
  • will not be re-exported in any form to any of the listed export controlled or embargoed Countries (D or E Group countries, see list).

Access, Distribution, Nature of Web Site Contents

Web site contents (including technology, information, data and software) available in the username- and password-protected areas of the Web site(s) are a private communication between the Web Site Host and authorized Users of the Web site(s). As such, access to and distribution of this information is limited to eligible Users that accept the Web Site User Agreement. The User certifies being an individual authorized to access the Web site(s) as defined in the personal description on the account certification page.

Each User also agrees not to disseminate personal information (i.e., product information, email addresses, telephone numbers, contact information, technology used etc.) to anyone outside the organization or Xpressions.

Terms, Conditions and Limitations on Usage

Web site contents are provided for the benefit of the companies (Xpressions Clients) sponsoring business and interest. User access to the Web site(s) is limited and authorized by us. The User certifies having a valid business reason to access the Web site(s) relating to the site(s) listed above.

In addition, the Web site User agrees to use any information, data, software, or technology obtained through or from the Web site(s) only for purposes related to conducting business related to this site and/or the activities of the authorizing organization. The Web site User agrees not to provide, share, or disseminate any information, data, software or technology obtained from the Web site(s) to any other person, company or organization outside the authorizing organization.

Further, Web site accounts requiring login with username and password are provided as a service to authorized and eligible individuals. Use of a Web site account indicates continued acceptance of the terms of this agreement and continued accuracy of the personal description registration information. The User agrees not to access or use the Web site(s) in breach of the terms of the User Agreement or when the personal description is not complete and accurate. The Web site account is not transferable and can not be used by anyone other than the individual to whom it was issued.

For security reasons, this site will record your personal computer information such as Computer Type, IP Address/Block, Internet Service Provider(ISP), related email address(s) account information from the ISP, Attempted Logon (Success/Failure), Attempted Logon Time/Date, and other keystrock activities. Unsuccessful logon attempts are analyzed against restricted "words" and/or "characters" database, and we may provide all related information to multiple law enforcement agencies for action.

Termination of Permission to Use Account

We retain the right to terminate a Web site account when a User's eligibility, authorization and/or affiliation changes such that the terms of this User Agreement are no longer valid.

All Web site Users understand and agree that Web site access may be terminated at anytime at the sole discretion of the Website owner or Xpressions. In addition, multiple failed login attempts will permanently block your computer(s) or computer network from accessing this restricted site in the future. You must contact the Webmaster for any questions and explanation.

Respecting and Protecting Intellectual Property Rights

The contents of the Web site(s) include copyrighted information. In addition, at least some of the technology and/or software from the Web site(s) is protected by U.S. and international patents. The User agrees to respect and protect any intellectual property relating to or originating from the contents of the Web site(s). In addition, the User agrees that the contents of the Web site(s) are the intellectual property of Xpressions.

Certification Required for Obtaining a Web Site Account

In order to receive an account for accessing the Web site(s) listed above, as a User, I certify the following to be true.

  1. I am an authorized user and employee of the business owning the site listed above.
  2. My access to the Web site(s) is provided based on one of the scenarios below.
    1. I will use Web site access only for valid business reasons related to the company; and I will not access the Web site(s) unless I remain a member in good standing of my business and I am currently employed in at least one of the following capacities:
      • as an employee of the company owning the site listed above
      • as an employee authorized by Xpressions and it's affiliate companies, or
      • as an authorized individual participating in a Web demo authorized by Xpressions.
    2. I am an individual that has been invited by an authorized representative of Xpressions or it's affiliate companies.
  3. I meet the citizenship, place of residence and export control requirements for having a Web site account.
  4. I have read, understood and agree to comply with all terms and conditions in the Web Site User Agreement.
